BELO MONTE HYDROELECTRIC: IMPACTS AND ENVIRONMENTAL LICENSING

Abstract

In the light of environmental law and the administrative mechanisms used to control human actions that interfere with environmental conditions, the present work aims to present the socio-environmental impacts resulting from the construction of the Belo Monte Hydroelectric power plant, explain how environmental licensing is effected the opposite in preventing environmental degradation. therefore, the article starts from the historical context of the construction process of the UHE Belo Monte, not only debating how the legal regiment was used in the formulation of administrative elements as preventive mechanisms, but also discussing the comparison to the degradation of the complex external environment. That directly influences the socio-spatial, historical and geographic dynamics of traditional and local communities that depend on the fauna and flora involved in this great undertaking. The legal analysis starts from the establishment of (co) responsibilities, rules and strategies for the management of the duty of environmental protection, in view of legislative mechanisms and instruments, as well as the environmental licensing that, in its applicability, proved to be contrary to the norms that make up the technical situation of this instrument in the quest to prevent and mitigate the environmental impacts of this large enterprise. Therefore, this case study seeks to present the social and environmental impacts arising from a political, administrative and bureaucratic game of the event that expressly marked the life of these communities.
