Abstract

This paper aims to analyze the concepts of secularism and state neutrality based on the debate held by the ministers of the Brazilian Supreme Court (STF) in ADI 4439, regarding confessional religious education in public schools. The main issue, brought to discussion in ADI 4439, is how to reconcile religious education in public schools, as provided for in article 210, §1, with the other two constitutional provisions relating to religious freedom (article 5, VI) and the secularism of the State (article 19, I). By determining the (non-)existence and/or (in)appropriate scope of state neutrality, it becomes possible to better evaluate and delimit the State's action in the religious sphere and, consequently, in the religious education of children and adolescents in public schools. The objective of this article is, therefore, to describe, articulate, and critically analyze the opinions of the STF ministers on the meaning and scope of the notion of neutrality in the secular State and the (un)constitutionality of confessional education in public schools.
