Abstract

This scientific article seeks to examine the practice of pre-procedural self-composition in the Brazilian legal system. By investigating alternative dispute resolution methods, the study will look at different aspects of self-composition before covering topics such as mediation, conciliation, negotiation and arbitration, highlighting the benefits and differences. It also investigates the viability of these practices in resolving disputes before the formal start of legal proceedings, and the options presented in the city of Campo Grande-MS. The results indicate that pre-procedural self-composition is a valuable tool for dealing with conflicts in Campo Grande-MS, providing an effective alternative to the formal judicial process, showing that there are many ways to achieve self-composition and that the State has been participating jointly with the Legal Institutions to create an enabling environment for the effective application of these practices. The study offers valuable insights for understanding the role of pre-procedural self-composition in the local legal scenario, contributing to the development of more efficient public policies and judicial practices in promoting the peaceful resolution of disputes.

Has a bachelor's degree in law from Faculdades Unidas Católicas Dom Bosco (1990), a master's degree in Law and Economics from Universidade Gama Filho (2004), a master's degree in Law from Pontifícia Universidade Católica de São Paulo (2004), and a Ph.D. in Law from Pontifícia Universidade Católica de São Paulo (2010). Currently, he is an associate professor at the Federal University of Mato Grosso do Sul and at Católica Dom Bosco University. He has experience in the field of Law, with emphasis on arbitration and mediation, mainly working on the following topics: access to justice, civil procedural law, arbitration, and mediation.
