Abstract

This research is an analysis of the increasing uncontrollable mining activities on the Yanonomi's Indigenous Territory (TIY) as a developmental discourse influenced practice that affects the right of permanent possession to the lands traditionally occupied by the indigenous communities. That is, the colonial mindset within the Brazilian state encourages the increase of invasions in the TIY's, these practices being supported by state oversight guided by the country's economic development project and so, endorses the humanitarian crisis on the TIY. Hence, the nature of this research is qualitative along a main inductive methodology, as it is based on the analysis of illegal mining's repercussions on the TIY. Regarding the research it will be necessary a law and anthropology bibliographic review; the document study will be conducted by data reports; legal-normative consultation; news reports and official documents form indigenous institutions. It is concluded that indigenous people continue to be at the mercy of state protection, having to fight as in ancient times, with the use of force to protect the TIY and its communities from mining activities that unfortunately were the protagonists of the health crisis experienced by the Yanomami.
