ADOÇÃO DE CRIANÇAS E ADOLESCENTES COM DEFICIÊNCIA EM ÂMBITO NACIONAL

Abstract

The present research intends to analyze the adoption institute about the challenges faced by children and adolescents with special needs.  To do so, an exploratory and bibliographic study was used through the collection of data found in books in the areas of Law, articles, scientific journals, and statistical data, to carry out a systematic reading for the theoretical foundation of the study.  In this sense, the concept of the adoption institute will be treated, its legislative historical evolution, its legal requirements, in addition to the inclusion of its rights in the national legal system.Emphasizing the legislation referring to the Civil Code of 2022, the Federal Constitution of 1988, Law nº 8.069/90, Law nº.  12.010/2009, and Law No. 12.955/14.  In addition, the reality experienced by children and adolescents with disabilities in foster homes is highlighted, as well as the search for a family nucleus that accepts their profile.  In this way, through research, it is possible to understand what is essential and necessary to overcome these challenges, being fundamental importance of the help of support groups, and public policies, as well as the legislative changes, developed to improve and make the process viable of special adoption, to guarantee the right to family and community coexistence of the infant.
