The Succession of Digital Assets in Brazil

Abstract

This article aims to analyze the succession of digital assets in Brazil, through the presentation of general concepts about succession law and subsequently the introduction of the topic involving digital assets and the way in which their transmission is treated, given the absence of specific legislation on the subject. The problem presented is centered on legislative omission and how this may affect the personality rights of the deceased when personal information is transmitted. The article also exposes the current Brazilian scenario in relation to digital inheritance, mentioning the existence of Bills, as well as court rulings that demonstrate the treatment that has been given to the subject. In the end, it is concluded that there is a need for legislative provisions on the subject, as well as for the Brazilian population to become aware of the measures to be adopted.
